STATEMENT BY THE SECRETARY GENERAL ON NICARAGUA
AND THE DECISION OF THE CENTRAL AMERICAN COURT

As a result of a visit to Nicaragua in October 2004 by the Acting Secretary General, Ambassador Luigi R. Einaudi, and the then Chair of the Permanent Council, Ambassador Aristides Royo, and in view of a decision on the matter by the OAS Permanent Council, the General Secretariat of this Organization is watching political developments and the observance and application of democratic principles in Nicaragua with special interest.

The Organization notes a decision issued yesterday, January 6, 2005, by the Central American Court of Justice, calling on “the National Assembly of Nicaragua to suspend proceedings for the ratification of amendments to the Political Constitution of the Republic of Nicaragua that were approved by the First Legislature on November 25, 2004, until the Court has ruled on the essence of the matter, and to suspend its consideration of the decision of October 7, 2004, by the Superior Council of Comptrollers of the Republic until a final ruling has been issued ... .”

The General Secretariat considers the separation of powers to be of great importance to the Hemisphere. The Inter-American Democratic Charter calls it an “essential element” of democracy. In each case, its application should be defined according to the legal framework of each state, in observance of international law, and as a fundamental value of democracy and peace among the peoples of the Hemisphere.
