RULES OF PROCEDURE FOR THE OPERATION OF THE
SPECIFIC FUND FOR THE “COMMITTEE FOR THE ELIMINATION OF
ALL FORMS OF DISCRIMINATION AGAINST PERSONS WITH DISABILITY"
(Adopted at its meeting held on March 18, 2009)
THE PERMANENT COUNCIL OF
THE ORGANIZATION OF AMERICAN STATES,
BEARING IN MIND the Inter-American Convention for the Elimination of all
Forms of Discrimination against Persons with Disability (hereafter the
Convention), adopted in Guatemala City on June 7, 1999, and whose main
objectives are to “prevent and eliminate all forms of discrimination
against persons with disability and to promote their full integration
into society”;
NOTING resolution AG/RES. 2167 (XXXVI-O/06) on the establishment of the
Committee provided for in the Inter-American Convention on the
Elimination of all Forms of Discrimination against Persons with
Disability (hereafter the Committee);
CONSIDERING operative paragraph 3 of resolution AG/RES. 2263
(XXXVII-O/07), creating the "Specific Fund for the Committee for the
Elimination of All Forms of Discrimination against Persons with
Disabilities";
TAKING INTO ACCOUNT resolution AG/RES. 2366 (XXXVIII-O/08), which
reiterates in operative paragraph 2 the importance of contributing to
the aforementioned Fund;
TAKING INTO ACCOUNT AS WELL the importance of the follow-up being done
by Committee on commitments established by the Convention and the
participation of its members in studying the progress made in
implementing the Convention and in the exchange of experiences among the
states parties; and
CONVINCED that the establishment of a specific fund for voluntary
contributions would facilitate fulfillment of the commitments
established in the Convention and would encourage participation on the
Committee by representatives of all states parties,
RESOLVES:
1. To approve the Rules of Procedure for the Operation of the Specific
Fund for the “Committee for the Elimination of all Forms of
Discrimination against Persons with Disability,” set forth in the Annex
to this resolution.
2. To invite all member states, permanent observer states and other
member states of the United Nations as well as the public or private,
national or international persons or institutions identified in Article
74 of the General Standards Governing the Operations of the General
Secretariat and in other provisions and regulations of the Organization,
to contribute to this Specific Fund.
3. To ask the Secretary General to promote this Specific Fund as widely
as possible.
ANNEX
RULES OF PROCEDURE FOR THE OPERATION OF THE SPECIFIC FUND FOR THE
“COMMITTEE ELIMINATION OF ALL FORMS DISCRIMINATION
AGAINST PERSONS WITH DISABILITY"
ARTICLE I – PURPOSE
1.1. The purpose of the Specific Fund for the "Committee for the
Elimination of all Forms of Discrimination against Persons with
Disability " (hereafter the Fund) shall be "to supplement financing for
the activities of the Committee and its Technical Secretariat and to
allow for the participation of representatives appointed by those states
parties that, owing to special circumstances, cannot finance such
participation.,” as provided for in resolution AG/RES. 2263
(XXXVII-O/07).
1.2. The activities of the Committee are understood to be those
undertaken for the purpose of meetings or gatherings of all its members,
as set forth in the Rules of Procedure of the Committee. Financing for
the Technical Secretariat shall be for support activities of the
Committee to perform its functions, in accordance with Article VI,
paragraph 7, of the Inter-American Convention on the Elimination of all
Forms of Discrimination against Persons with Disability (hereafter the
Convention) and Articles 6 and 7 of the Committee’s Rules of Procedure.
1.3. Contributions to the Fund do not prevent other voluntary
contributions to underwrite activities that are underway or other
activities of the Committee and its Technical Secretariat.
ARTICLE 2 – RESOURCES
2.1. The Fund will be made up of voluntary contributions by member
states, permanent observer states to the OAS and other member states of
the United Nations as well as the public or private, national or
international persons or institutions that may wish to finance
activities identified in Article I. Contributors to the Fund may
specify, expressly or in writing, the purpose of their contributions.
ARTICLE 3 – ADMINISTRATION AND FINANCIAL MANAGEMENT
3.1. The General Secretariat of the OAS shall be responsible for the
administration and financial management of the Fund in accordance with
its rules and procedures. The General Secretariat of the OAS shall be
supported by the Department of International Law, which performs the
functions of Technical Secretariat of the Committee.
3.2. The costs involved in administering the Fund shall be underwritten
by the Fund itself in accordance the rules and procedures governing the
General Secretariat of the OAS.
3.3. The Permanent Council shall review the viability and effectiveness
of this Fund two years from the date of its establishment or before if
the General Secretariat of the OAS reports that the Fund does not have
sufficient resources.
3.4. The General Secretariat of the OAS shall submit an annual report to
each regular session of the General Assembly, reflecting the activities
of the Fund, contributions received during the corresponding year, and
its financial status. This report shall form part of the Annual Audit
Report of Accounts and Financial Statements.
3.5. The account of the Fund will be audited in the annual audit
conducted by the General Secretariat of the OAS, and the results shall
be presented in the annual report of the Board of External Auditors.
ARTICLE 4 – AMENDMENT AND ANNULMENT
4.1. These Rules of Procedure shall take effect after adoption by the
Permanent Council and shall be amended by the Permanent Council on its
own initiative or on the recommendation of the Secretary General.
