In this session, panelists will consider the Guide on the Law Applicable to International Commercial Contracts in the Americas, which was approved by the Inter-American Juridical Committee in March, 2019, with a particular focus on the Guide’s 18 recommendations, specifically those that encourage and support party autonomy and choice of law. Panelists will also explain the Guide’s development and its foundation in the Inter-American Convention on the Law Applicable to International Contracts, known as “the Mexico Convention, and its connection with the Hague Principles on Choice of Law in International Commercial Contracts. The discussion will conclude with pragmatic considerations concerning implementation of the Guide’s recommendations by states, legislators, adjudicators and contracting parties.
