IACHR Celebrates Full Compliance with Friendly Settlement Agreement in Case 12,960 Concerning Honduras

Washington, D.C. – The Inter-American Commission on Human Rights (IACHR) has decided to declare full compliance with Friendly Settlement Report 269/21, concerning Case 12,960—Ronald Jared Martínez et al., Honduras—and will stop monitoring it.

The case concerns the international responsibility of the Honduran State for injuries caused by police and military officers to José Roberto Martínez and to the children Ronald Jared Martínez Velásquez, 10, and Marlón Fabricio Hernández Fúnez, 5, in a shooting that followed a traffic offense. The petitioner noted that the individuals responsible for these events had not been punished and that the victims had also not received reparation for the rights violations they had suffered.

On September 22, 2020, the parties signed a friendly settlement agreement that was approved by the Commission on October 5, 2021. While verifying the implementation of this agreement, the Commission noted the Honduran State's efforts to comply with measures concerning financial compensation for the victims, which was paid out in a single instalment as agreed by the parties.

The Inter-American Commission closely followed the implementation of the friendly settlement that was agreed in this case. The IACHR highly commended both parties on their efforts in negotiations and, later, during the monitoring stage of the agreement. Based on information provided by the parties during the monitoring process, the IACHR declared that full compliance had been attained, and consequently ended its supervision of compliance with this friendly settlement agreement.

The Commission further commends the Honduran State on its efforts to solve cases that are taken before the petition and case system—through its friendly settlement mechanism—and on the full implementation of this friendly settlement agreement. The Commission congratulates the petitioning party for all its efforts to take part in negotiations and to seek implementation of this agreement.

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for and to defend human rights in the region and acts as a consultative body to the OAS in this area. The Commission is composed of seven independent members who are elected in an individual capacity by the OAS General Assembly and who do not represent their countries of origin or residence.
