CONTINUACI=D3N DE LA = CONSIDERACI=D3N DE LOS=20 RECIENTES ACONTECIMIENTOS

OCURRIDOS ENTRE HONDURAS Y=20 NICARAGUA

 

El PRESIDENTE: I am pleased to call to order = this special=20 meeting of the Permanent Council, as agreed by the Council = yesterday, to=20 continue consideration of the situation that has developed between = Honduras and Nicaragua.

As agreed yesterday, the representatives of the = governments of Honduras and Nicaragua met with the Secretary = General, the=20 Assistant Secretary General, and the Chair in an attempt to find = some=20 common ground between the parties on this issue and to come up = with a=20 measure that would take us forward.

A full-fledged observer mission was considered = by the=20 Secretary General to be beyond our capacity at this time. He = considered it=20 much more feasible that an emissary, not a mediator, be dispatched = as soon=20 as possible to conduct a fact-finding mission, report back to the = Council,=20 and make recommendations if s/he saw fit on measures that might = take us=20 further forward. In the meantime, we expect that the dispatch of = this=20 emissary would serve to lower tensions in the region and minimize = the=20 probability of any outbreak of hostilities between the parties. Of = course,=20 both parties are very anxious to avoid such an outbreak.

The Chair fully agrees with this course of = action, as=20 recommended by the Secretary General, and further recommends that = the=20 Permanent Council authorize the Secretary General to appoint a = suitable=20 emissary who would enjoy the confidence of both parties.

I now give the floor to the Secretary General, = who will=20 present more detailed aspects of this initiative.

El SECRETARIO GENERAL: Gracias, se=F1or = Presidente.

Como lo ha referido con alg=FAn detalle el = se=F1or Presidente=20 del Consejo Permanente, en la tarde de ayer tuvimos la ocasi=F3n = de=20 reunirnos con las Delegaciones de Honduras y de Nicaragua para = explorar=20 f=F3rmulas, decisiones que ayuden a que la Organizaci=F3n de los = Estados=20 Americanos pueda desempe=F1ar un papel moderador, un papel que = evite toda=20 circunstancia que pueda presentar hostilidades de car=E1cter = b=E9lico o=20 incidentes de car=E1cter militar, como quiera que los = llamemos.

Intercambi=E9 puntos de vista con las dos = Delegaciones y=20 hubo un examen cuidadoso de las posibilidades de lo que podr=EDa = hacerse de=20 manera inmediata. Obviamente, las ambas Delegaciones, a su manera, = tienen=20 puntos de vista fuertes y conciben el papel de la Organizaci=F3n = como un=20 papel, digamos, activo. Nicaragua, particularmente, quiere = sentirse segura=20 de que vamos a actuar de una manera que evite un enfrentamiento de = las=20 caracter=EDsticas mencionadas.

Creo que las solicitudes que los dos pa=EDses = hicieron de=20 la necesidad de una misi=F3n de observadores es algo sobre lo cual = tendremos=20 que trabajar en los d=EDas que vienen. No es algo que debamos = descartar; es=20 algo que debemos tener presente. Abr=EDa que trabajar en un = mandato, abr=EDa=20 que mirar cu=E1les ser=EDan las caracter=EDsticas de esa misi=F3n = de observadores,=20 cu=E1l ser=EDa exactamente su papel para evitar un incidente de = esta=20 naturaleza y ver en qu=E9 medida la Organizaci=F3n puede o no = realizar una=20 misi=F3n de esas caracter=EDsticas y, si no, ver qui=E9n puede = asumir esa=20 responsabilidad o qui=E9n la puede acometer, si es un tema de las = Naciones=20 Unidas, lo que sea. Creo que sinceramente que debemos trabajar en = esa=20 iniciativa y tratar de ver cu=E1les ser=EDan las caracter=EDsticas = para que esa=20 misi=F3n sea =FAtil, y en qu=E9 medida la OEA puede cumplir esa = funci=F3n.

Lo que creo que la OEA puede y debe hacer es = nombrar un=20 representante del Secretario General, o un enviado, como queramos=20 denominarlo, para que, de manera inmediata, acometa la tarea de ir = encontrando mecanismos, haciendo consultas, buscando maneras de = evitar ese=20 conflicto y esa hostilidad y, eventualmente, presentar un informe = al=20 Consejo y hacerle unas recomendaciones. Esa persona, obviamente, = tendr=EDa=20 que ser aceptada por las dos partes.

Si al Consejo le parece que lo que el = Secretario General=20 est=E1 proponiendo es viable, lo que har=EDamos es explorar, = tratar de=20 encontrar un hombre en el cual los dos pa=EDses encuentren = suficientes=20 garant=EDas, de manera de poder estar seguros de que estamos = trabajando en=20 la direcci=F3n correcta. Creo que, si acertamos en la escogencia = de esa=20 persona y si esta idea es acogida por los miembros del Consejo, es = muy=20 probable que las recomendaciones que nos haga, que la = presentaci=F3n que nos=20 haga del tema nos ayude a movernos a etapas ulteriores, si ello es = necesario.

Hasta donde yo tengo entendido, las dos = Misiones estar=EDan=20 en disposici=F3n de aceptar una f=F3rmula de esa naturaleza. = Entiendo bien que=20 no les parece que esta sea la soluci=F3n y, efectivamente, no es = la soluci=F3n=20 al problema. Es encontrar un mecanismo para buscar una soluci=F3n. = Es tener=20 un mecanismo que nos ayude a aliviar tensiones, a identificar = conflictos=20 potenciales, a ver qu=E9 pueden hacer los pa=EDses para evitar = esas=20 situaciones y que m=E1s deber=EDa hacer el sistema interamericano = y la=20 Organizaci=F3n para desempe=F1ar un papel positivo en estas=20 circunstancias.

Tal vez limitar=EDa mi intervenci=F3n a estas = palabras.=20 Quiero reiterar que me parece esencial que la Organizaci=F3n = act=FAe en estas=20 circunstancias, que me parece que la Organizaci=F3n, al actuar, = tiene buenas=20 posibilidades de ser =FAtil y de evitar que se presente una = confrontaci=F3n.=20 Est=E1 meridianamente claro, para las partes y para todo el mundo, = que ese=20 enviado o ese representante no se va a inmiscuir en los temas de = fondo. No=20 va a tratar de mediar en el diferendo que existe sobre el Tratado = o sobre=20 las consecuencias del Tratado. Esa no es su responsabilidad. Su=20 responsabilidad es trabajar en aquellas materias que pongan en = peligro la=20 paz. Evitar que se vaya a quebrantar la paz de la regi=F3n y la = amistad,=20 como se=F1alan algunos de los art=EDculos de nuestra Carta. O sea, = esta=20 persona estar=EDa trabajando, exclusivamente, sobre esos temas que = amenazan=20 la paz. No tendr=EDa nada que hacer ni ver en los temas de = fondo.

Si esta propuesta es acogida por el Consejo, = esta misma=20 tarde, yo empezar=EDa a trabajar para buscar un nombre que sea = aceptable a=20 las partes y pueda actuar de manera inmediata, para que el sistema = interamericano asuma las responsabilidades que debe asumir cuando = ve que=20 la paz del Hemisferio est=E1 amenazada, como lo est=E1, = evidentemente.=20 Gracias, se=F1or Presidente.

El PRESIDENTE: Thank you very much, Mr. = Secretary=20 General.

I want to make it clear=97just in case it did = not come=20 across=97that we met yesterday with the two representatives = individually,=20 not together.

I now call on the distinguished Representative = of Mexico=20 to address us.

El REPRESENTANTE PERMANENTE DE M=C9XICO: Muchas = gracias.=20 Se=F1or Presidente, hemos escuchado con mucha atenci=F3n sus = palabras, as=ED=20 como la presentaci=F3n que acaba de hacer el Secretario General. = Mi=20 Delegaci=F3n se pronuncia a favor de la designaci=F3n de un = representante del=20 Secretario General, cuya misi=F3n tendr=EDa por objetivo recoger = la=20 informaci=F3n pertinente, establecer contacto con los dos = Gobiernos, tanto=20 el de Nicaragua como el de Honduras, y presentarnos en su = oportunidad un=20 informe. Pensamos que este es un paso l=F3gico antes de cualquier=20 consideraci=F3n de acci=F3n futura.

Sin embargo, se=F1or Presidente, tambi=E9n = pensamos que,=20 habiendo escuchado el d=EDa de ayer las presentaciones del se=F1or = Canciller=20 de Honduras y del se=F1or Viceministro de Nicaragua y tomando en = cuenta las=20 tensiones que han ocurrido en los =FAltimos d=EDas en las = relaciones entre=20 ambos pa=EDses hermanos, ser=EDa muy oportuno que este Consejo = aprobara una=20 declaraci=F3n o una resoluci=F3n, como se la quiera llamar, que, = en primer=20 lugar, recoja el compromiso de ambos Gobiernos de encontrar una = soluci=F3n=20 negociada a las diferencias que los oponen en este momento. = Pensamos que=20 el d=EDa de ayer escuchamos un compromiso con una soluci=F3n = negociada, una=20 vocaci=F3n pacifista tanto por parte de Nicaragua como por parte = de=20 Honduras. Pensamos que debemos recoger esos pronunciamientos y = creemos que=20 esto ser=EDa un elemento importante.

En segundo lugar, otro elemento tambi=E9n = importante es que=20 creo que el Consejo puede invitar que las partes se abstengan de = adoptar=20 medidas que podr=EDan llevar a un agravamiento de la situaci=F3n = actual y, en=20 tercer lugar, se expresar=EDa la disposici=F3n de la = Organizaci=F3n de los=20 Estados Americanos de contribuir, dentro de sus atribuciones, = dentro de=20 sus capacidades y limitaciones, a una soluci=F3n de la actual = situaci=F3n que=20 viven ambos pa=EDses.

Pensamos que esto ser=EDa oportuno porque, el = anuncio del=20 env=EDo o del nombramiento de un representante del Secretario = General, si=20 bien favorece justamente un ambiente de distensi=F3n, tomar=E1 = algunos d=EDas=20 para que sea designado, para que pueda viajar y establecer los = contactos=20 informales.

En este sentido, creo que ser=EDa muy oportuno = que este=20 Consejo apruebe una declaraci=F3n o una resoluci=F3n con los = elementos que=20 hemos mencionado. Muchas gracias, se=F1or Presidente.

El PRESIDENTE: Thank you very much, Ambassador. = Do we=20 have any further comments? I recognize the distinguished = Representative of=20 the United States.

El REPRESENTANTE ALTERNO DE LOS ESTADOS UNIDOS: = Thank you=20 very much, Mr. Chairman. My delegation would also like to = congratulate=20 you, Mr. Chairman, the Secretary General, and the Assistant = Secretary=20 General for your work with the delegations of Honduras and = Nicaragua in=20 coming up with an acceptable course of action for both parties in = pursuing=20 a permanent, peaceful solution to the current dispute. My = delegation=20 shares concerns that both parties should abstain from any kind of = actions=20 that might aggravate the current disagreement.

We do support the idea of a special emissary to = the=20 region. It seems to us the most appropriate response, at least for = the=20 short-term, to a request from two member states that deserve an = adequate=20 response from this organization. They have come to the Permanent = Council=20 seeking help in an area where a multilateral organization like the = Organization of American States can play a very helpful role. This = is an=20 opportunity for us to explore, through this special emissary to be = appointed by the Secretary General, what further steps the = Organization=20 might appropriately take.

The governments of Honduras and Nicaragua have = both=20 pledged their commitment to seek a peaceful solution. We urge them = to=20 abstain from any activities that might aggravate the current = situation and=20 to exercise caution in their public rhetoric, because in a = sensitive=20 situation like this, rhetoric can inflame the situation = unnecessarily.

We also support the Delegation of Mexico=92s = suggestion=20 that we pass a resolution=97if both parties are comfortable with=20 that=97expressing our desire for a peaceful solution to this = dispute.

El PRESIDENTE: Thank you very much. I now give = the floor=20 to the distinguished Representative of Jamaica.

El REPRESENTANTE PERMANENTE DE JAMAICA: Thank = you, Mr.=20 Chairman. I take the floor to make two points: one by way of = clarification=20 and the other by way of recommendation.

First, my delegation has listened carefully to = the debate=20 in the Permanent Council. In several interventions yesterday, = reference=20 was made to Jamaica consulting with Nicaragua. Let me state, Mr. = Chairman,=20 that we have not engaged in any negotiations with Nicaragua nor = with=20 Honduras, neither here through the OAS nor directly from capitals. = So I=20 want to clear up any misunderstanding by stating the facts in = regard to=20 that.

Second, Mr. Chairman, the Secretary General = made a=20 proposal, which I think is useful, that we appoint an emissary to = try to=20 assist both countries in taking their dialogue further and coming = to a=20 peaceful resolution of this difficult issue. I=92d like to support = the=20 proposal. The Organization has a long and admirable record of = assisting=20 countries to sort out difficult problems, and I think that this is = an=20 opportunity for the OAS to be of service.

El PRESIDENTE: Thank you very much. The = distinguished=20 Representative of Canada has the floor.

El REPRESENTANTE PERMANENTE DEL CANAD=C1: Thank = you very=20 much, Mr. Chairman. My delegation congratulates you and the = Secretary=20 General for efforts engaged in yesterday and commends the = flexibility of=20 the delegations of Honduras and Nicaragua in agreeing to the idea = of=20 having a special emissary visit their countries to attempt to = diffuse the=20 situation.

The Government of Canada heartily endorses the = proposal=20 made by the Secretary General regarding a special emissary and = agrees with=20 the conditions for the activities of this emissary, as just = described by=20 the Secretary General. We reiterate our call for a pacific = settlement to=20 this dispute and encourage both parties to exercise sober = restraint in=20 their activities and in their public utterances on the issue.

Finally, I would like to endorse the proposal = made by the=20 Ambassador of Mexico regarding a resolution, declaration, or = statement by=20 this Council that would indicate the resolve of the Council, = support the=20 efforts of the Secretary General and the special emissary, and = indicate to=20 all that this Council remains engaged on this sensitive and very = important=20 issue.

El PRESIDENTE: Thank you very much. I recognize = the=20 distinguished Representative of Grenada.

El REPRESENTANTE PERMANENTE DE GRENADA: Thank = you, Mr.=20 Chairman. My delegation affirms that peace in our region and our=20 hemisphere should be the ultimate objective of all member states,=20 regardless of the circumstances, because there is too much at = stake. The=20 events that necessitated this special meeting of the Permanent = Council=20 require careful assessment; therefore, my delegation supports the=20 initiatives outlined by the Chairman and the Secretary = General.

We urge caution to avoid any action that may = create any=20 further irritation in the relationship between the two countries. = This=20 region regards cooperation and integration with respect. We = encourage the=20 use of peaceful means, under the established framework of the = Charter and=20 beyond, to ease anxiety and achieve peaceful settlement and = sustenance of=20 the peace process that we now enjoy. We must not attempt in any = way to=20 turn back the clock. Our peoples depend on peace for progress.

El REPRESENTANTE INTERINO DEL URUGUAY: Gracias, = se=F1or=20 Presidente. Mi Delegaci=F3n ha venido siguiendo muy atentamente, a = partir=20 del d=EDa de ayer, el desarrollo de las sesiones del Consejo sobre = este=20 problema que nos ata=F1e, y ha recibido instrucciones de mi = Gobierno de=20 apoyar todo tipo de instrumento o procedimiento que facilite el = di=E1logo=20 tendiente a evitar un litigio entre las partes. Creemos que el = mecanismo=20 que ha expuesto el se=F1or Secretario General se adecua a estos = fines y lo=20 apoyamos en forma muy enf=E1tica.

Tambi=E9n queremos apoyar la iniciativa de = M=E9xico, en el=20 sentido de que el Consejo apruebe una resoluci=F3n o = declaraci=F3n, y estamos=20 dispuestos a integrar el grupo de trabajo que se forme, si es = posible esta=20 misma ma=F1ana, para llegar a un acuerdo sobre un texto lo m=E1s = r=E1pido=20 posible. El REPRESENTANTE INTERINO DE LA ARGENTINA: = Muchas=20 gracias, se=F1or Presidente. Por su intermedio, perm=EDtanos = agradecer=20 enf=E1ticamente al se=F1or Secretario General la tarea que viene = desarrollando=20 en torno a esta cuesti=F3n, particularmente en torno a la = propuesta que esta=20 ma=F1ana nos ha presentado. Adem=E1s de ser el producto de las = intensas=20 conversaciones que mantuvo en el d=EDa de ayer, estimamos que es = lo correcto=20 en estas circunstancias.

Efectivamente, tal como lo ha presentado, es el = recurso=20 m=E1s apropiado en este momento, ya que est=E1 orientado = precisamente a que se=20 de en la pr=E1ctica el ambiente que se ha verificado en la = sesi=F3n de ayer:=20 tratar de aliviar la tensi=F3n, tratar de buscar soluciones a un = desacuerdo=20 que manifiestamente tiene que ser resuelto por la v=EDa = pac=EDfica.

Adem=E1s, se=F1or Presidente, hemos escuchado = con mucho=20 inter=E9s la propuesta formulada por el distinguido Representante = de M=E9xico=20 en torno a la conveniencia de que este Consejo se pronuncie de una = manera=20 espec=EDfica sobre esta cuesti=F3n. Nosotros interpretamos que la = presencia de=20 los distinguid=EDsimos representantes de las partes involucradas = en este=20 desacuerdo, lo que han manifestado en torno a su vocaci=F3n de paz = y su=20 preocupaci=F3n por mantenerla, ya implica una se=F1al muy clara = del compromiso=20 y la voluntad que estos dos pa=EDses tienen de solucionar = pac=EDficamente este=20 tema.

En ese sentido, cualquier documento que = produzcamos aqu=ED=20 tendr=EDa que recoger y acoger con benepl=E1cito ese compromiso, = para que=20 efectivamente ese esp=EDritu de di=E1logo y de paz prevalezca en = todo momento.=20 Al mismo tiempo, ese documento =96declaraci=F3n o resoluci=F3n, = veremos=96 tiene=20 que acoger la medida que el se=F1or Secretario General nos propone = de enviar=20 un representante suyo, precisamente para ayudar a que ese = compromiso tenga=20 visos de realidad y que, efectivamente, conduzca a una soluci=F3n = pac=EDfica=20 de este tema.

Esperamos con mucho entusiasmo las propuestas = que=20 permitan tomar la decisi=F3n que corresponda. Muchas gracias, = se=F1or=20 Presidente.

El REPRESENTANTE PERMANENTE DE CHILE: Muchas = gracias,=20 se=F1or Presidente. En el d=EDa de ayer hemos escuchado las = solicitudes del=20 distinguido Secretario en el Despacho de Relaciones Exteriores de = Honduras=20 y del se=F1or Viceministro de Relaciones Exteriores de Nicaragua, = hemos=20 escuchado la buena voluntad de ambos pa=EDses por reducir las = tensiones y=20 por resolver sus conflictos. El hecho de que ambos hayan acudido a = la=20 Organizaci=F3n no solamente nos obliga a dar una respuesta, sino = que creemos=20 que ese es precisamente el primer elemento muy positivo que = debemos tener=20 en cuenta de la sesi=F3n de ayer y de los eventos posteriores.

Mi Delegaci=F3n, se=F1or Presidente, agradece a = usted, al=20 Secretario General y al Secretario General Adjunto los esfuerzos = por=20 producir una propuesta y coincidimos en que ella merece todo el = respaldo=20 de este Consejo.

Creemos que todo acuerdo en este sentido debe = ser un=20 arreglo entre las partes con respeto al derecho internacional, y = que para=20 lograr ese acuerdo debemos ejercer la prudencia, debemos = considerar todos=20 los factores involucrados y debemos alentar la serenidad en el = curso de=20 estos eventos.

De manera, se=F1or Presidente, que considero = que una=20 resoluci=F3n o declaraci=F3n, como nos ha propuesto el distinguido = Embajador=20 de M=E9xico, puede ser una forma muy eficaz de recoger ese = esp=EDritu positivo=20 de ambas partes, de alentar la propuesta de nuestro Secretario = General y,=20 en definitiva, de establecer una respuesta de la Organizaci=F3n = dentro de=20 sus competencias. Si el Consejo as=ED lo decidiese, nos gustar=EDa = tambi=E9n=20 formar parte del grupo que se ocupe de redactar el texto de dicha=20 declaraci=F3n o resoluci=F3n.

Se=F1or Presidente, si recogemos el genuino = esp=EDritu=20 mostrado ayer por ambas Delegaciones, estamos seguros de que = podremos=20 avanzar, con la prudencia que corresponde en estos casos, en la = resoluci=F3n=20 de este tema y hacer que la Organizaci=F3n y todos los pa=EDses = que participan=20 en ella contribuyan as=ED a la paz en la zona. El REPRESENTANTE PERMANENTE DE PANAM=C1: Muchas = gracias,=20 se=F1or Presidente. Mi Delegaci=F3n desea tambi=E9n expresar su = apoyo a la=20 propuesta de enviar un emisario especial o un representante del = Secretario=20 General, como quiera que lo llamemos, para que haga las consultas=20 necesarias y presente un informe al Consejo Permanente. Creo que = es un=20 primer paso que es necesario tomar y que, estoy seguro, tendr=E1=20 repercusiones favorables.

Estamos de acuerdo con que este emisario debe = ser=20 cuidadosamente seleccionado, debe ser sumamente capacitado e = id=F3neo y debe=20 conocer la realidad latinoamericana, muy en especial la realidad=20 centroamericana.

Igualmente, apoyamos la propuesta, hecha por el = distinguido Embajador de M=E9xico, de que el Consejo emita una = declaraci=F3n o=20 una resoluci=F3n =96personalmente me inclino por una resoluci=F3n, = ya que la=20 misma tiene m=E1s fuerza. Dicha resoluci=F3n deber=EDa contener lo = que la=20 Organizaci=F3n de los Estados Americanos desea alcanzar en este=20 conflicto.

Por otro lado, mi Delegaci=F3n desea expresar = sus mejores=20 votos por una pronta soluci=F3n de este diferendo, ya que a = Panam=E1, como=20 pa=EDs amante de la paz que es, le preocupa enormemente la = situaci=F3n que se=20 ha creado entre Nicaragua y Honduras, dos pa=EDses amigos y = vecinos con los=20 que Panam=E1 mantiene v=EDnculos de especial confraternidad por = ser ambos=20 verdaderos hermanos del istmo centroamericano. Nada nos produjo = mayor=20 satisfacci=F3n que haber o=EDdo ayer al Vicecanciller de Nicaragua = y al=20 Canciller de Honduras expresar sus buenos deseos de alcanzar una = soluci=F3n=20 negociada y amistosa.

Por =FAltimo, quisiera recalcar que debemos = actuar en forma=20 r=E1pida. Este enviado especial debe ser nombrado lo antes posible = y, como=20 dije anteriormente, debe ser una persona id=F3nea, debe ser una = persona=20 sumamente capacitada y debe ser una persona que conozca muy bien = la regi=F3n=20 centroamericana. En primer t=E9rmino, mi = Delegaci=F3n desea=20 expresar su agradecimiento y su felicitaci=F3n, tanto a usted, en = su=20 condici=F3n de Presidente del Consejo Permanente, como al = Secretario=20 General, por las gestiones llevadas a cabo en el d=EDa de ayer = para poder=20 formular una iniciativa que sea pertinente y =FAtil en las = circunstancias en=20 que se encuentran Nicaragua y Honduras.

Por otra parte, mi Delegaci=F3n desea expresar = su mayor=20 reconocimiento tanto a Honduras como a Nicaragua, por la confianza = que han=20 puesto en nuestra Organizaci=F3n al venir a la misma a plantear = sus puntos=20 de vista, as=ED como por la vocaci=F3n de paz que han demostrado = en sus=20 intervenciones en el d=EDa de ayer ante el Consejo Permanente y en = las=20 acciones que han tomado en torno a su presencia en la = Organizaci=F3n. Por otro lado, apoyamos que el Consejo = Permanente se=20 pronuncie con una resoluci=F3n, como lo propuso la distinguida = Delegaci=F3n de=20 M=E9xico. El REPRESENTANTE PERMANENTE DE COLOMBIA: Muchas = gracias,=20 se=F1or Presidente. Es para referirme muy brevemente al tema que = se est=E1=20 debatiendo en el d=EDa de hoy y a dos temas que tambi=E9n tienen = que ver con=20 el debate que se inici=F3 ayer.

En primer lugar, quisiera apoyar la propuesta = del se=F1or=20 Secretario General, como la han apoyado tambi=E9n quienes han = hecho uso de=20 la palabra hasta ahora, en el sentido de que se designe un enviado = especial que pueda ayudar a solucionar este problema.

En segundo lugar, quisiera tocar dos otros = temas. Uno=20 tiene relaci=F3n directa con los l=EDmites de Colombia en aguas = del Caribe y=20 el otro est=E1 relacionado con algunas versiones de prensa.

Sobre el tema de los l=EDmites de Colombia en = el Caribe,=20 nuestro pa=EDs quiere ser muy claro, espec=EDficamente frente a la = Rep=FAblica=20 de Nicaragua. Colombia tiene que decir que sus relaciones han = estado=20 enmarcadas siempre dentro del derecho internacional y han sido = totalmente=20 respetuosas de este y de todos los principios que lo rigen. Quiere = declarar formalmente que el Tratado B=E1rcenas Meneses-Esguerra es = un=20 tratado plenamente vigente y v=E1lido, suscrito en 1928, sus = ratificaciones=20 canjeadas, previa aprobaci=F3n de los respectivos Congresos, en el = a=F1o 1930.=20 Desde entonces se ha venido dando estricto cumplimiento al citado=20 Tratado.

Como es bien conocido, los t=EDtulos de = Colombia sobre el=20 archipi=E9lago de San Andr=E9s y Providencia datan de la Real = Orden del 20 de=20 noviembre de 1803, lo cual ha sido plenamente acogido por todos = los=20 Estados y por la comunidad internacional. El Virreinato de Nueva = Granada y=20 despu=E9s la Rep=FAblica de Colombia ha venido ejerciendo en una = forma=20 p=FAblica, pac=EDfica e ininterrumpida su jurisdicci=F3n sobre el = archipi=E9lago=20 de San Andr=E9s y Providencia y las =E1reas mar=EDtimas que = generan.

Estoy mencionando estos hechos con el fin de = que quede=20 muy claro, se=F1or Presidente y se=F1ores Representantes, la = posici=F3n de=20 Colombia frente a la hermana Rep=FAblica de Nicaragua. Frente a la = Rep=FAblica=20 de Honduras, como ustedes saben muy bien, en el a=F1o de 1986 se = firm=F3 el=20 Tratado que recientemente fue sometido a aprobaci=F3n tanto del = Congreso de=20 Honduras como del Congreso de Colombia.

Como han surgido algunos rumores y algunas=20 interpretaciones frente a la posici=F3n de Colombia, quiero = tambi=E9n dejar en=20 claro que frente a versiones de prensa relacionadas con = declaraciones no=20 oficiales del Gobierno de Colombia sobre presunta movilizaci=F3n = de una=20 corbeta y de aviones militares colombianos en aguas del Caribe, el = Gobierno de Colombia, a trav=E9s de esta representaci=F3n, = manifiesta=20 categ=F3ricamente que Colombia, en esa zona mar=EDtima, ha = mantenido por=20 d=E9cadas presencia permanente con el fin de preservar sus = recursos de pesca=20 y, en =E9pocas recientes, tambi=E9n para combatir el = narcotr=E1fico.

En ning=FAn momento ha variado su indeclinable = l=EDnea de=20 conducta en esta materia y todas las acciones de nuestro pa=EDs = han estado=20 precedidas del estricto cumplimiento de los tratados vigentes y el = principio de buena fe. Muchas gracias, se=F1or Presidente.

El PRESIDENTE: Thank you very much. I now give = the floor=20 to the distinguished Representative of Nicaragua.

El VICEMINISTRO DE RELACIONES EXTERIORES DE = NICARAGUA:=20 Se=F1or Presidente, se=F1ores Embajadores, agradezco antes que = nada la=20 presentaci=F3n del honorable se=F1or Embajador de Jamaica, porque = ante este=20 foro ha aclarado que no hemos tenido, el Gobierno de Jamaica y el = Gobierno=20 de Nicaragua, ninguna negociaci=F3n que sirva o pudiera haber = servido de=20 pretexto a la hermana Rep=FAblica de Honduras para negociar el = Tratado de=20 L=EDmites con Colombia.

La posici=F3n de mi pa=EDs al venir aqu=ED ha = sido la b=FAsqueda=20 de la paz, que consideramos el bien m=E1s valioso. He escuchado = con especial=20 atenci=F3n las declaraciones del honorable se=F1or Embajador de = Colombia y=20 debo decirle que este no es el foro para venir a escuchar o = resolver las=20 cuestiones hist=F3ricas a las que =E9l se ha referido. Debo = enfatizar que=20 Nicaragua desconoce el Tratado B=E1rcenas Meneses-Esguerra, = impuesto a mi=20 pa=EDs cuando se encontraba bajo la ocupaci=F3n extranjera. = Adem=E1s, el Tratado=20 B=E1rcenas Meneses-Esguerra de ninguna manera fija l=EDmites = marinos con la=20 Rep=FAblica de Colombia.

Debo advertir tambi=E9n al Gobierno de = Colombia, por medio=20 de su honorable Representante, que declaraciones como las que ha = brindado=20 el general Fernando Tapia, comandante militar, son poco = afortunadas en=20 este momento y en nada contribuyen a la paz de los = centroamericanos. El=20 general Fernando Tapia declar=F3 al diario El Colombiano, de = Medell=EDn:

=85 que nueve aviones de combate y una = corbeta militar=20 fueron desplazados por Colombia al archipi=E9lago de San = Andr=E9s y cayos=20 vecinos, para ejercer control a=E9reo sobre las zonas = mar=EDtimas=20 colombianas y prevenir cualquier violaci=F3n a la=20 soberan=EDa.

Se=F1ores Representantes, es evidente que esta = declaraci=F3n=20 es inoportuna y en nada contribuye a la paz que todos deseamos. Yo = hago=20 una exhortaci=F3n para disminuir la tensi=F3n. No hay que creer = que haciendo=20 ostentaci=F3n de fuerza, como lo hace esta declaraci=F3n, se va a = limitar o=20 atemorizar a mi pa=EDs, que tiene una larga trayectoria que ha = demostrado el=20 valor en todos los campos posibles. No vamos a aceptar que una = medida como=20 esta venga a perturbar la paz que todos los centroamericanos = deseamos.=20 Nicaragua ha sufrido demasiado por la guerra. Mi pa=EDs desea la = paz.

Debo decirles, se=F1ores, que acabo de recibir = inquietantes=20 noticias de la frontera de Honduras con Nicaragua. A las 7:40 p.m. = del=20 domingo, cinco soldados del Ej=E9rcito, de la Polic=EDa de = Hacienda de=20 Honduras, instalados en el lugar conocido como El Cementerio, = frente a El=20 Porvenir, en Jalapa, realizaron al aire varios disparos de Galick = y=20 fusiles con r=E1fagas de ocho tiros, provocando zozobra en los = pobladores=20 nicarag=FCenses. Esta es s=F3lo una noticia en la prensa de mi = pa=EDs, pero=20 revela el estado de tensi=F3n existente.

Por esa raz=F3n y con instrucciones de mi = Gobierno, acojo=20 con gran satisfacci=F3n el nombramiento de un emisario que tenga = un mandato=20 claro, un mandato que haga referencia a las necesidades y al = trabajo a=20 realizarse para evitar que un conflicto armado haga de esta = porci=F3n de=20 territorio centroamericano, a la que hemos querido consagrar como = una=20 regi=F3n de paz, una zona convulsiva con efectos econ=F3micos que = ser=EDan=20 desastrosos para Centroam=E9rica, en especial para los dos = pa=EDses m=E1s pobres=20 de la regi=F3n.

Quiero apoyar, en nombre de mi Gobierno, la = iniciativa=20 del se=F1or Secretario General del nombramiento de un emisario con = las=20 caracter=EDsticas que el se=F1or Secretario General ha se=F1alado. = Creo que es=20 un primer paso, sin dejar por ello de retirar, de ninguna manera, = lo que=20 antes he solicitado: observadores mar=EDtimos en las aguas en = disputa.

Debo decirles que mi pa=EDs de ninguna manera = acepta la=20 imposici=F3n que se pretende mediante este Tratado de evitar = patrullajes=20 arriba del paralelo 15. Mi pa=EDs dejar=E1 de hacer patrullajes en = esta zona=20 en disputa en tanto que la Rep=FAblica de Honduras tambi=E9n lo = haga. No=20 podemos nosotros limitar los derechos soberanos de mi pa=EDs por = un tratado=20 en el cual no ha sido parte. De ninguna manera podemos aceptar la=20 imposici=F3n de fronteras por otros pa=EDses.

Nicaragua reitera su derecho a patrullar las = aguas arriba=20 del paralelo 15. Exhortamos a la hermana Rep=FAblica de Honduras = que, con el=20 sentimiento de paz que convenimos, retire su patrullaje en esas = aguas y=20 Nicaragua estar=EDa dispuesta en cualquier momento a considerar = tambi=E9n el=20 retiro del patrullaje de esas aguas donde puede generarse un = conflicto,=20 sobre todo si en esas aguas hay intervenci=F3n de un tercer = pa=EDs. Muchas=20 gracias, se=F1or Presidente.

La REPRESENTANTE PERMANENTE DE HONDURAS: = Gracias, se=F1or=20 Presidente. En nombre del Gobierno de Honduras quiero reiterar, en = este=20 foro de di=E1logo m=E1s importante de las Am=E9ricas, su decidido = compromiso con=20 la integraci=F3n, la paz y el progreso de la regi=F3n = centroamericana, as=ED=20 como la firme voluntad pol=EDtica del Presidente Carlos Flores = para llegar a=20 un entendimiento satisfactorio y honorable con la Rep=FAblica de = Nicaragua=20 en torno al tratado Ram=EDrez-L=F3pez.

El d=EDa de ayer, el Canciller Roberto Flores = Berm=FAdez puso=20 en conocimiento del Consejo Permanente los pronunciamientos y = acciones=20 asumidas por el Gobierno de Nicaragua. Asimismo, inform=F3 que, = ante estos=20 hechos, Honduras ha respondido redoblando esfuerzos por sostener = un=20 di=E1logo directo y juicioso, fundamentado en el derecho = internacional y la=20 fiel observancia de las normas aceptadas de soluci=F3n pac=EDfica = de=20 controversias.

Ante estos sucesos, el Gobierno de Honduras, = mediante=20 nota fechada el 2 de diciembre dirigida al Secretario General, se = refiri=F3=20 "a la urgente necesidad de que nuestra Organizaci=F3n adopte, con = la=20 urgencia y celeridad que el caso amerita, una decisi=F3n tendiente = al env=EDo=20 de una misi=F3n de observadores a la frontera de mi pa=EDs con la = hermana=20 Rep=FAblica de Nicaragua".

Dicha solicitud se efectu=F3 en la b=FAsqueda = de generar=20 condiciones propicias que fomentaran y permitieran restaurar la = confianza=20 y alejar cualquier intento desproporcionado de reacci=F3n que no = se enmarque=20 dentro de la observancia de los principios b=E1sicos de = convivencia pac=EDfica=20 de los Estados.

Sin embargo, en atenci=F3n al anuncio de = someter, de ser=20 necesario, las diferencias surgidas a la jurisdicci=F3n de la = Corte=20 Internacional de Justicia y al compromiso con la paz expresado el = d=EDa de=20 ayer por el Excelent=EDsimo se=F1or Guillermo Arg=FCello Poessy, = Viceministro de=20 Relaciones Exteriores, que refleja la buena fe del Gobierno de la=20 Rep=FAblica de Nicaragua, Honduras se pronuncia favorable a la = propuesta=20 realizada por el se=F1or Secretario General de la Organizaci=F3n, = de designar=20 un emisario especial con el consentimiento de las partes, para que = visite=20 los dos pa=EDses, conozca de la situaci=F3n y someta el respectivo = informe al=20 Consejo Permanente, que ser=E1 el =F3rgano responsable de tomar = las acciones=20 que estime pertinentes.

Asimismo, nos pronunciamos de acuerdo con la = propuesta=20 del distinguido Representante Permanente de M=E9xico y agradecemos = a las=20 Misiones que han expresado su apoyo para que el Consejo se = pronuncie con=20 una resoluci=F3n o declaraci=F3n que acoja el compromiso que han = establecido=20 ambos pa=EDses con la paz y los mecanismos contemplados en el = derecho=20 internacional y que inste al cese de actos que puedan provocar = tensiones y=20 que sean contrarios al clima de confianza que debe prevalecer en = estos=20 momentos.

Mi Gobierno no descarta su solicitud original = del env=EDo=20 de una misi=F3n de observadores en la eventualidad de suscitarse=20 hostilidades e incidentes violentos que propicien el = escalonamiento de la=20 situaci=F3n que actualmente se presenta.

Se=F1or Presidente, el Gobierno de Honduras = expresa su=20 agradecimiento a los miembros del Consejo Permanente por su apoyo = y ayuda=20 en el camino de la soluci=F3n pac=EDfica de las diferencias entre = Honduras y=20 Nicaragua, as=ED como tambi=E9n al doctor C=E9sar Gaviria = Trujillo, Secretario=20 General, por su gesti=F3n a favor de la paz y seguridad de la = regi=F3n=20 centroamericana.

 

Honduras, se=F1or Presidente, reitera su = voluntad=20 permanente de utilizar los m=E9todos de soluci=F3n pac=EDfica = previstos por el=20 derecho internacional en la determinaci=F3n de sus l=EDmites = mar=EDtimos en el=20 Pac=EDfico y en el Atl=E1ntico, as=ED como su firme compromiso con = los=20 prop=F3sitos y principios de la Carta de la Organizaci=F3n de los = Estados=20 Americanos, en los cuales se fundamenta su actuar internacional. = Muchas=20 gracias, se=F1or Presidente.

The Chair now proposes that the Council approve = the=20 Secretary General=92s recommendation that the OAS authorize the = Secretary=20 General to designate an emissary for the purposes that we have = discussed=20 here. I think we should first agree on that; afterwards, I will = ask you to=20 approve the establishment of a committee to draft an appropriate=20 resolution. Since a resolution is stronger than a declaration, and = since=20 some members are more supportive of a resolution, I suggest that = we draft=20 a resolution rather than a declaration.

I was = very=20 strongly inclined not to say anything, but my knowledge of English = idiom=20 overcame me, and I believe it should read "with the appointment = of" rather=20 than "with appointing." It=92s not idiomatic in English to say = "with=20 appointing." So we have to say "with the appointment of a special = . . . ."=20 I hope you trust my British education.

As to the point raised by the Ambassador of = Brazil=20 regarding paragraph 4, I=92m a little uncertain. Have we agreed on = the=20 English text of paragraph 4? It reads: "As quickly as possible and = with=20 all due urgency. . . ." There is a little overlap there, even in = English.=20 As a matter of fact, if you say "with all due urgency," it would = seem to=20 me that you don=92t need "as quickly as possible." Would you agree = that if=20 in English we say "with all due urgency," we don=92t need "as = quickly as=20 possible"? We agree on that. So we will delete "as quickly as = possible."=20 Presumably we will do likewise in the Spanish version.
