EXECUTIVE ORDER No. 84-1
SUBJECT:  AMENDMENT OF THE STAFF RULES

 

THE SECRETARY GENERAL,

    Pursuant to the powers conferred upon him by Article 115 of the Charter of the Organization and Articles 8 and 11 of the General Standards to govern the Operations of the General Secretariat,

WHEREAS:

    That it is necessary to amend Staff Rules 105.9 and 112.1 to reflect specific elements of the new Performance Appraisal System approved by Directive of the Secretary General published in Memorandum SG/15/84, of February 27, 1984,

RESOLVES:

1. To amend Staff Rule 105.9 by adding the following paragraphs:

(f) A staff member who is dissatisfied with his evaluation must, before exercising his rights under Staff Rule 112.1, request a preliminary hearing from the Director of the Department of Human Resources within 15 days after his receipt of the evaluation form duly signed by all levels of supervision. The preliminary hearing shall proceed in accordance with the special hearing procedure set forth below:

(i) The hearing request must be in writing and state with specificity the reasons why the staff member considers the evaluation unjust, what factors he believes were not taken into account, and, in general, his position on the matter. Failure to submit the written hearing request within the 15 day limitation period shall forever extinguish the employee's rights to contest the evaluation.

(ii) The Director of the Department of Human Resources shall appoint a hearing officer who shall request the immediate supervisor to submit a statement. Failure of the supervisor to submit such a statement within 10 days of his receipt of the request shall result in a finding for the petitioner. The hearing officer may request any other information he considers necessary for preparing a report which he shall present to the Director of the Department of Human Resources within 30 days of the receipt of the hearing request by the Department of Human Resources. The Director of the Department of Human Resources will review the hearing officer's report and shall make a decision.

(iii) If the staff member considers that the decision of the Director of the Department of Human Resources affects his interests, he may, within 15 days after having been officially informed of such decision, request a hearing under Staff Rule 112.1 (a).

    (g)  Failure to complete the evaluation as required in the pertinent provisions and within the specified time limits will result in the following administrative measures:

(i) Holders of non-classified positions will answer directly to the Secretary General.

(ii) Any within-grade salary increase due the supervisor responsible for failure to complete the evaluation will be withheld until the next regular cycle.

If an evaluation cannot be completed because the staff member or supervisor is absent for any reason the Director of the Office or Department in which the affected staff member works must send a written explanation to the Director of the Department of Human Resources at least 15 days before the deadline.

2.   To substitute the number 10 for the number 20 in paragraph (b) of Staff Rule 112.1, which shall state:

(b)  Within 20 days following the interested staff member's presentation of his written statement, the Secretary General shall decide whether to withdraw the measure, confirm, or change it.

3. This Executive Order shall enter into force the day it is signed.
