OAS MODEL LAW ON SWORN STATEMENTS OF INTEREST DISCUSSED IN ARGENTINA

International Experts from Argentina, Brazil, Chile, Colombia, Spain, the United States, and Mexico, as well as from the World Bank and the OAS General Secretariat, gathered in Buenos Aires, Argentina, to discuss a draft model law on sworn statements of interest for those who exercise public functions.

This event, which took place on May 31 and June 1, 2011, forms part of a broader technical cooperation program that the OAS General Secretariat, through the Department of Legal Cooperation of the Secretariat for Legal Affairs, has been developing with resources from the Government of Spain, in order to promote the strengthening of the legal-institutional instruments of the States that form part of the Follow-Up Mechanism of the Implementation of the Inter-American Convention against Corruption (MESICIC) and international cooperation actions to confront corruption, within the framework of that Mechanism.

At the meeting, the participants shared their technical and legal knowledge, as well as experiences and best practices in the field from their respective countries and organizations. Thanks to this first phase of discussion and the contributions obtained throughout the event, the draft model law will be enriched and will reflect important provisions related to those persons obligated to report, including the terms, deadlines, content and forms for the submission of statements, as well as other provisions related to the procedures for verifying, registering, safeguard and custody of statements and a regime of administrative and criminal sanctions for noncompliance.

The new version of the draft model law will subsequently be disseminated so that other national experts, and international and civil society organizations that have interest in it, can give their opinion on its content and thus contribute to its enrichment.


OAS PARTICIPATES IN PERMANENT FORUM OF PROSECUTORS OF ADMINISTRATIVE INVESTIGATIONS AND ANTICORRUPTION OFFICE OF ARGENTINA

The General Secretariat of the OAS, through the Department of Legal Cooperation of the Secretariat for Legal Affairs, was invited to participate in the opening session for the training organized by the Permanent Forum of Prosecutors of Administrative Investigations and Anticorruption Offices of the Republic of Argentina, which took place on June 1, 2011, in Casa de la Provincia de Santa Fe, in Buenos Aires.

In his remarks, Doctor Jorge García González, Director of the Department of Legal Cooperation, shared with the representatives of anticorruption entities in Argentina and other participants, OAS developments in hemispheric cooperation against Corruption, principally within the framework of the Inter-American Convention against Corruption and the Follow-Up Mechanism for its Implementation.

The Forum was created six years ago and constitutes an institutional opportunity for the existing entities in the Argentine provinces that are focused, as specialized agencies, on the development of anticorruption and transparency policies, both in the field of investigation as well as prevention, to meet.

Currently, the Forum is made up of the Anticorruption Office of the Nation; the Anticorruption Office of Chubut; the Anticorruption and Public Ethics Office of Entre Ríos; the Provincial Directorate for Anticorruption and Transparency in the Public Sector of Santa Fe; the Anticorruption Office of the Municipality of Morón; the Prosecutor of Administrative Investigations of the Nation; the Prosecutor of Administrative Investigations of La Pampa; Prosecutor of Administrative Investigations of Río Negro; Prosecutor of Administrative Investigations of Chaco; the Prosecutor of the State of de Tierra del Fuego and Islands of the South Atlantic; the Directorate of Administrative Investigations of the Municipality of Rosario; the Collection Agency for the province of Buenos Aires (Arba); the Anticorruption Office of la Matanza; and the Sub-Directorate of Summaries and Administrative Investigations of the city of Córdoba.
