REPUBLIC OF TRINIDAD AND TOBAGO

Act No. 7 of 2001 [L.S.]

AN ACT to amend the Mutual Assistance in Criminal Matters Act, 1997

[Assented to 20th September, 2001]

ENACTED by the Parliament of Trinidad and Tobago as Enactment

Follows:-

1. This Act may be cited as the Mutual Assistance in Short title

Criminal Matters (Amendment) Act, 2001.

(Amendment)

Interpretation Act 2. In this Act, "the Act" means the Mutual Assistance No. 39 of 1997 in Criminal Matters Act, 1997.

Section 3 amended 3. Section 3 of the Act is amended by deleting subsection (2) and substituting the following new subsection:

" (2) The Attorney General may delegate any of his functions under this Act to any public officer or legal officer employed in the Ministry of the Attorney General and Legal Affairs.".

Section 40 4. Section 40 of the Act is amended- (a) by inserting after subsection (1), the following subsection:

" (IA) Where a treaty has been concluded, whether before or after the commencement of this Act, between Trinidad and Tobago and any other territory, providing for mutual assistance in any criminal matter arising or criminal offence committed in Trinidad and Tobago or such other territory, not including a criminal offence referred to in subsection (1), the Attorney General may, by Order subject to negative resolution of Parliament, declare that the treaty shall have the force of law in Trinidad and Tobago subject to such limitations, exceptions or qualifications as may be specified in the Order.":

(b) in subsection (2), by inserting after the words "subsection (1)", the words "or subsection (IA)";

(c) in subsection (3), by inserting after the words "subsection (1)", the words "or subsection (IA).".
