AG/RES. 2 (XXII-E/96)

PARTICIPATION IN THE INTER-AMERICAN COUNCIL FOR INTEGRAL DEVELOPMENT (CIDI) WHEN THE PROTOCOL OF MANAGUA ENTERS INTO FORCE BY MEMBER STATES THAT HAVE NOT RATIFIED THAT PROTOCOL

(Resolution adopted at the first plenary session, held on January 29, 1996)

THE GENERAL ASSEMBLY,

HAVING SEEN the report of the Secretariat for Legal Affairs contained in the January 21, 1996, memorandum, as well as the December 18, 1969, memorandum from the Department of Legal Affairs, attached to the report of the Secretariat for Legal Affairs (CP/CG-233 corr. 1); and

CONSIDERING:

That it is necessary to adopt special rules to permit those member states that have not ratified the Protocol of Managua when it enters into force to participate in CIDI and its bodies;

That Article 53.a of the Charter assigns to the General Assembly the power "to decide the general action and policy of the Organization, determine the structure and functions of its organs, and consider any matter relating to friendly relations among the American States";

That all the American states that ratified or acceded to the Charter signed in Bogotá on April 30, 1948, are members of the Organization;

That Article 70 of the Charter states that all the member states have the right to be represented on each of the Councils, and that each state has the right to one vote;

That when the Protocol of Buenos Aires entered into force in 1970 the General Assembly, at its first special session, adopted resolution AG/RES. 2 (I-E/70), which established, for member states that had not ratified that Protocol, rules for participation in the bodies of the Organization; and

That resolution AG/RES. 2 (I-E/70) was based on a December 18, 1969, opinion of the Department of Legal Affairs (CP/CG-233 corr. 1) and the related comments of the member states,

RESOLVES:

1. That the member states of the Organization that have not yet deposited their respective instruments of ratification of the Protocol of Managua may participate in the work and activities of CIDI and its bodies, with the same rights and responsibilities as those member states that have ratified it.

2. That this resolution shall remain in force until the next regular session of the General Assembly, at which the Assembly will review this situation if at that time there are still member states that have not ratified the Protocol of Managua.
