The Intermamerican Convention against Corruption was adopted at the Specialized Conference about the Project of Interamerican Convention against Corruption, convoked by Res. 1346 (XXV-0/95) of the OAS General Assembly and held on March 29, 1996 in Caracas, Venezuela.
Acording to the provisions of this Convention, it would come into force on the thirteenth day from the date in which the second ratification instrument would have been deposited, condition that was fullfiled on March 6, 1997. This publication contains the text of this Convention, in the four official languages of the Organization - Spanish, French, English and Portuguese.

This book will be of interest to people that wish to know, from an analitical point of view and also for practical effects, a wide spectrum of available measures against corruption. One of these, the Interamerican Convention against Corruption, adopted in 1996, helps to join the ideas that some authors came up, among them high officials, members of congress, experts in international public law and influential international advisors. The book brings together the materials presented in a seminar for the divulgation and implementation of the Interamerican Convention against Corruption, sponsored by the Commission.

This book contains some thoughts and analysis about the issue of corruption, and also interesting jurisprudence and detailed legislation, among them the Interamerican Convention against Corruption.
This editorial effort was made by two workshops that were promoted by the National Commission for the Improvement of the Administration of Justice (NCIAJ) and the Organization of American States (OAS), held in 1998, to divulge and implement the Interamerican Convention against Corruption.
The publication -in addition of the important diffusion job- has the peculiarity that collects opinions from different people, who in their interventions, give the reader the possibility of shaping a wide and guiding vision of this worry-some reality.

To celebrate the Fiftieth Anniversary of the OAS, an international workshop was held concerning corruption and the Inter-American Convention on this same subject. The workshop was held under the auspices of the Organization of American States (OAS), in conjunction with the participation of Secretary General of the OAS, the Department of Legal Cooperation and Information of the OAS, and the Faculty of Law of Javeriana University. The workshop not only dealt with the articles of the Convention themselves; it included discussions concerning the development of a strategy to fight corruption in Colombia. The workshop also will also help to produce results that will improve Colombia's standing in the Transparency International index. This book hopes make a positive contribution to the maintenance of a follow up strategy to combat this problem in the countries of the region.

La publicación que hoy tenemos el agrado de presentar a la comunidad jurídica latinoamericana, es fruto del decidido esfuerzo de la Secretaría General de la Organización de Estados Americanos por desarrollar actividades legislativas para el combate de la corrupción, fenómeno multifactorial y multiforme que amenaza la vigencia de las instituciones democráticas y compromete el desarrollo económico y social de nuestros países.
Se ha dicho, en muchos lugares, que la complejidad del problema de la corrupción impide, de alguna manera, su tematización desde la óptica del Derecho, ya que el acercamiento jurídico a sus manifestaciones suele ser tardío y circunscrito a los casos que, con alguna dificultad, se documentan y se persiguen formalmente. Esto es especialmente cierto cuando la única óptica para atacar el fenómeno de la corrupción depende del impacto de las sanciones de carácter penal, las cuales se suelen listar dentro del ámbito de los delitos funcionales.
Sin embargo, también es cierto que la atención a los diversos aspectos que caracterizan a la corrupción no debe circunscribirse únicamente al Derecho Penal, sino que debe haber un acompañamiento legislativo en otros sectores, que permita afinar el instrumental con el que cuenta el ordenamiento jurídico para impedir el secreto, la ignorancia y la desinformación, elementos que suelen proveer el terreno fértil en el que se desarrolla y se difunde la corrupción dentro de las instituciones del Estado y en la sociedad.
En atención a los compromisos asumidos en su propia Carta de la OEA y a los esfuerzos hechos durante estos años por darle ejecutividad a la Convención Interamericana contra la Corrupción, es que se ha propuesto generar un debate fructífero y provechoso en Centroamérica acerca del posible marco legal que podría acompañar políticas públicas de transparencia, acceso e información a la colectividad que propicien, de manera eficaz, un ambiente no proclive a la corrupción, en sus variadas formas.
Este objetivo se materializó en la labor desplegada por esta Secretaría General durante el año recién pasado, al ejecutar el proyecto de cooperación técnica, que tuvo como objetivo central apoyar a Guatemala, Honduras, El Salvador, Nicaragua y Costa Rica en la adecuación de su ordenamiento jurídico a las disposiciones de la Convención Interamericana contra la Corrupción, en lo atinente a las medidas preventivas contempladas en el artículo III de la misma, específicamente en lo que atañe a los siguientes temas: desarrollo del derecho ciudadano de acceso a la información para la prevención de la corrupción, la promoción de la participación ciudadana en los asuntos públicos, la protección de testigos de actos de corrupción y de las reglas encaminadas al establecimiento de normas de conducta para el correcto, honorable y adecuado desempeño de las funciones públicas, así como una normativa sobre declaración de ingresos, pasivos y activos, por parte de quienes desempeñen funciones públicas.
Esta publicación contiene los resultados del proyecto de cooperación técnica mencionado y presenta las leyes modelo que se elaboraron durante la ejecución de este proyecto.
