MINISTRY OF THE INTERIOR (19)

Art. 34.           The Ministry of the Interior is responsible for the areas of justice, public security and other internal matters such as:

1.             Overseeing matters referring to the country’s political and administrative organization.

2.             Advising the President and Cabinet Ministers on draft legislation and legislative amendments submitted to it for consideration.

3.             Acting as a channel of communication and coordination between the Executive Branch and the Supreme Court, the Office of the Attorney General and the National Judicature Council.

4.             Giving its opinion on the advisability of signing or ratifying international agreements related to the ministry’s sphere of competence and certifying the legality of the obligations contracted by the government and its institutions to institutions requesting such certification.

5.             Directing, on behalf of the President, the activities of the National Civil Police Force and the National Public Security Academy.

6.             Coordinating national efforts to combat organized crime, money laundering and corruption and supporting the prevention of the illegal consumption and use of drugs, their control and supervision, and the treatment and rehabilitation of addicts, and complying with the country’s international commitments in this area.

7.             Coordinating, where necessary and legally permissible, the actions of public security forces with the Ministry of National Defence and the State Intelligence Agency.

8.             Exercising control over immigration, deciding on applications from foreigners for naturalization, the renunciation of Salvadoran citizenship and its recovery, issuing passports and carrying out other actions related to immigration policy.

9.             Establishing the State’s penitentiary policy, in accordance with the legal principles, and organizing, directing, maintaining and overseeing penitentiaries, with a view to the rehabilitation of prisoners and their reinsertion into society.

10.         Deciding on petitions for the commutation of sentences.

11.         Granting legal status to non-profit organizations and foundations and religious institutions, in accordance with the law, keeping a register of those organizations, and authorizing foreign associations and foundations to operate in the country.

12.         Authenticating and communicating the decrees, decisions, orders and resolutions issued by the President when they deal with matters related to the Office of the President, and related to matters that are not specific.

13.         Promoting and strengthening a culture of social peace, through the evaluation and control of cinematographic material, television and radio programs, and prevention and guidance relating to objectionable public spectacles that could lead to the loss of values or promote a climate of violence, particularly among children and youths.

14.         Organizing and maintaining a system of prevention, guidance, mitigation and response to disasters and emergencies of any kind on the national level.

15.         Exercising the other powers established in the laws or regulations, those entrusted to it by the President, and those not expressly entrusted to other government ministries.

16.         Representing the country abroad in its sphere of competence, in coordination with the corresponding agencies.

Art. 34-A.       The functions and powers of the Ministry of the Interior will be exercised directly or though its existing agencies and institutions, and those established in future, or which are incorporated into it under regulations or laws. (19)[1]

[1] (19) Article 28 was amended under Decree 124 of 18 December 2001, published in Official Gazette No. 241 of 20 December 2001. Article 34 and its paragraph were replaced, creating the Ministry of the Interior (Ministerio de Gobernación) and establishing its powers. Article 34-A was added. Article 44 was revoked. Article 5 of the decree reads: “Where the legal provisions or regulations mention the Ministry of the Interior (Ministerio del Interior) or the Ministry of Public Security and Justice, the Ministry of Public Security or the Ministry of Justice or the head of those ministries, they shall be construed as referring to the Ministry of the Interior (Ministerio de Gobernación) or its head, respectively.” The decree also made provision for the transfer of the assets of the two ministries that had been eliminated. (Translator’s note: Ministerio del Interior and Ministerio de Gobernación both translate into English as Ministry of the Interior.)
