Particular Customary International Law in the Context of the Americas

In March 2024, the Inter-American Juridical Committee adopted a report on "Particular Customary International Law in the Context of the Americas" (document CJI/doc.719/24) that studies this source of international law, under its particular scope in the context of the Americas. Among its conclusions, the Committee notes that particular customary international law is shaped by a combination of two elements: practice and opinio juris; that the existence of a particular customary international norm is not presumed; that the acts and omissions of individuals can only be relevant to the establishment of such a norm if they are attributable to States; and, that the methodology for proving said norm is uniform in the different fields of international law. The resolution adopting the report bears the same name: " Particular Customary International Law in the Context of the Americas", CJI/RES. 290 (CIV-O/24).
