On March 13, 2014, during its
84th regular session, the Inter-American
Juridical Committee adopted a report on
“Corporate Social Responsibility in the Field of
Human Rights and the Environment in the
Americas”,
document CJI/doc.449/14.rev1.
This second report on the
issue reviews regional initiatives, including
resolutions of the Organization of American
States and Inter-American Conferences, surveys
differences among domestic laws, and presents an
analysis of corporate practice in light of
decisions by the Inter-American Commission on
Human Rights and the Inter-American Court of
Human Rights.
It is worth noting that the
Committee also adopted a set of "Guiding
principles for member states" which seek to
strengthen progress made by the region, hoping
to be able to help overcome existing obstacles
and weaknesses. Stemming from a mandate from the
Committee itself, this guide is based on a
variety of instruments adopted at the
hemispheric and international levels, and
includes the specificities of the region and the
conclusions of the report.
The report adopted through
resolution CJI/RES. 205 (LXXXIV-O/14)
supplements a preliminary document prepared in
August 2013 –document CJI/doc.436/13– which
explains the situation with corporate social
responsibility in the region. The body of case
law gathered by the Committee in these documents
reflects the information conveyed by Argentina,
Colombia, El Salvador, Jamaica, Dominican
Republic and the United States regarding their
existing domestic legislation in the matter,
included court decisions deemed relevant.
