Analysis of legislation and public policies supporting PES

The DSD has analyzed existing legal and regulatory frameworks at the national level in the Andean and Central American Regions in areas such as forest management, water resources management, biodiversity, fiscal incentives, natural resource valuation, recognition of ecological services, public utilities, agricultural trust funds, property rights, and funding for conservation, among others, to determine which provisions facilitate or inhibit these type of mechanisms. 

Existing transactions from the PES inventory developed by the OAS were also analyzed in order to identify key elements within institutional infrastructure and public policies that allow PES and other transactions to function. Commonalities at the national level arising from the analysis were highlighted, as were gaps that need to be addressed. These gaps and elements, together with best practices, have been taken into consideration for the development of a hemispheric approach to PES.
