DATE FOR THE SEVENTH INTER-AMERICAN SPECIALIZED CONFERENCE ON
PRIVATE INTERNATIONAL LAW (CIDIP-VII) REGARDING THE AGENDA ITEM
“SECURED TRANSACTIONS: ELECTRONIC REGISTRIES FOR IMPLEMENTATION
OF THE MODEL INTER-AMERICAN LAW ON SECURED TRANSACTIONS. CONSIDERATION OF MODEL REGISTRY REGULATIONS UNDER THE MODEL
INTER-AMERICAN LAW ON SECURED TRANSACTIONS

THE PERMANENT COUNCIL OF THE ORGANIZATION OF AMERICAN STATES,

RECALLING that the CIDIP process is the principal component of the Organization of American States for the progressive development and harmonization of private international law in the Western Hemisphere, by means of which 26 inter-American instruments have been adopted;

CONSIDERING:

That the General Assembly, by its resolution AG/RES. 1923 (XXXIII-O/03), convened the Seventh Inter-American Specialized Conference on Private International Law (CIDIP-VII);

That the General Assembly, by its resolution AG/RES. 2065 (XXXV-O/05), adopted two agenda items for CIDIP-VII, the first being “Consumer Protection: Applicable Law, Jurisdiction, and Monetary Redress (Conventions and Model Laws)”; and the second “Secured Transactions: Electronic Registries for Implementation of the Model Inter-American Law on Secured Transactions”;

That, with regard to secured transactions, the Permanent Council has approved the Draft Model Registry Regulations under the Model Inter-American Law on Secured Transactions, presented by member states, and, in that connection, convened a three-day meeting to be held at OAS headquarters, in Washington, D.C., from October 7 to 9, 2009;

That the Permanent Council, at its regular meeting of May 22, 2009, forwarded to the Committee on Administrative and Budgetary Affairs (CAAP) a request to consider the funding of CIDIP-VII on the secured transactions item;

That at its regular meeting held on August 11, 2009, the CAAP approved the funds needed to hold this conference, in accordance with General Assembly resolution AG/RES. 2202 (XXXVI-O/06), “Meetings of the Organization of American States – Funding Criteria and Budgetary Guidelines,” and submitted a report in that regard to the Permanent Council at its regular meeting of August 13, 2009;

That the General Assembly, by resolution AG/RES. 2527 (XXXIX-O/09), instructed the Permanent Council to set up a working group with a view to completing the draft final document or documents on consumer protection, to submit a progress report thereon by January 31, 2010, and to set the dates for CIDIP-VII on consumer protection once the experts complete their work; and

That the Government of Brazil has offered to host CIDIP-VII on the consumer protection item; and

TAKING INTO ACCOUNT the successive reports on the preparations for CIDIP-VII prepared by the Department of International Law of the Secretariat for Legal Affairs, which give account of the drafting efforts made over the past six years, such efforts requiring an adequate level of representation by and attention from the official delegations of the member states,

RESOLVES:

1. To set October 7 to 9, 2009 as the date to hold, at the headquarters of the Organization, the Seventh Inter-American Specialized Conference on Private International Law (CIDIP-VII) regarding the item “Secured Transactions: Electronic Registries for Implementation of the Model Inter-American Law on Secured Transactions. Consideration of the Model Registry Regulations under the Model Inter-American Law on Secured Transactions.

2. To invite the governments of the member states of the Organization that are interested in participating in this conference to forward the credentials of their delegations, reminding them that, under the Regulations, delegates must be accredited by their ministries of foreign affairs.
